PRIVACY POLICY

We also collect information about your interaction with our website. We may also use website analytics tools on our site to retrieve information from your browser, including the site you came from, the search engines and keywords you used to find our site, the pages you view within our site, the links you click on, your browser add-ons, and your browser’s width and height.

Additionally, we may use technologies, such as cookies and web beacons, to collect information about the pages you view, the links you click and other actions you take on our sites and services.   • Verify participant’s eligibility as a qualified startup or investor
  • Facilitate matching of startups to interested investors
  • Share information you have voluntarily provided about yourself with matched participants and Flywheel staff in order to operate Pitch-Space.
  • Match startups with the area of focus, category or services best suited to your company
  • Communicate with you by e-mail, postal mail, telephone and/or mobile devices about your account and/or interested investors.
  • Perform auditing, research and analysis about your use of our website so that we can make improvements.
  • Ensure the technical functioning of our network.
  • Develop new services.
  • Manage our business.
  • Perform functions as otherwise described to you at the time of collection.

 

Choices for personal information – If we propose to use personal information for any purposes other than those described in this Privacy Policy, we will offer you an effective way to opt out of the use of personal information for those other purposes. We will not collect or use sensitive information for purposes other than those described in this Privacy Policy, unless we have obtained your prior consent.

 

Information sharing – Your personal information consists of the information you submitted regarding yourself, your company, and other information you submitted to us. We may share your personal information with Investors and Flywheel staff insofar as it is necessary to run Pitch-Space accounts. However, Investors will only have access to personal information that you disclose in your account profile and data room.

We only share personal information with other companies or individuals outside of Pitch-Space or Flywheel LLC in the following limited circumstances:

  • We have your consent.
  • We provide opt-out functionality for the sharing of any sensitive personal information.
  • We provide such information to trusted third-party businesses or persons for the purpose of performing services, such as website development, on our behalf. We require that these parties agree to perform these services based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.
  • We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) detect, prevent, or otherwise address fraud, security or technical issues, or (c) protect against harm to the rights, property or safety of Flywheel, its users or the public as required or permitted by law.

We may share aggregated and non-personal information with third parties, including advisors, advertisers and investors, for the purpose of conducting general business analysis. For example, we may tell our advertisers the number of visitors to our website and the most popular features or services accessed. This information does not contain any personal information and may be used to develop website content and services that we hope you and other users will find of interest.

 

Access to your personal data – We make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes.

We will occasionally update this Privacy Policy to reflect changes in our practices and services. When we post changes to this Privacy Policy, we will revise the “last updated” date at the top of this statement. If we make any material changes in the way we collect, use, and/or share your personal information, we will notify you by sending an email to the email address you most recently provided us. ACCOUNT INFORMATION

By applying to Pitch-Space and using the other services offered by Flywheel LLC, you agree to the current terms and conditions of the site. Recording sessions, post production and account profile maintenance is offered at $30 / month. We will charge Your credit card on a monthly or annual basis. Payments are non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. If the card information you provide expires and you do not provide new card information, or cancel your bank account, you authorize us to continue billing you and you agree to remain responsible for any uncollected Fees.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties. You recognize and concur that any charge card and related charging and installment data that you give to Pitch-Space, powered by Flywheel LLC might be shared by Flywheel LLC with other sites and plug-ins including but not limited to installment processors and credit offices, exclusively for checking credit, affecting installment payment to Flywheel LLC and adjusting your records.

Pitch-Space powered by Flywheel LLC may change its charges and installment approaches for the Pitch-Space by advising you at least thirty (30) days before the start of the charging cycle in which such change will produce results. You can opt to upgrade or downgrade your service agreement to any other plan that Pitch-Space is currently offering for sale at any time during your contract term. In the event of a contract downgrade, a discount credit will be issued to your Slides account for the difference in the cost of the two contracts over the remainder of your original contract term. At the end of the contract term, your contract will automatically renew for an additional contract term until explicitly cancelled by you.

Cancellation must be issued via your user panel or via Pitch-Space customer support. Any cancellation carried out via Pitch-Space customer support must be carried out at least two (2) working days prior to the end of the contract term to allow for adequate processing time. Services may be terminated by us, without cause, at any time. Services may be terminated by you, without cause, by following the cancellation procedures via your user panel or Slides customer support. Slides may terminate Services at any time, without penalty and without notice if you fail to comply with any of the terms of this Agreement or the intellectual property protections applicable to these Services. Notice of termination of Services by Pitch-Space may be sent to the contact e-mail associated with your account. Upon termination, Slides has the right to delete all data, files, or other information that is stored in your account. The contact and personal information we collect about you will never be shared outside of Flywheel LLC. LIMITS ON LIABILITY

By participating in Pitch-Space, each account entrant agrees to release, defend, indemnify and hold harmless Flywheel LLC, their respective employees, agents and representatives (including advertising agencies), and all service providing contractors associated with Pitch-Space powered by Flywheel LLC (the “Released Parties”) from and against any and all claims arising from a breach of the entrant’s representations, warranties and covenants, and any and all injury, loss, or damage caused or claimed to be caused by an entrant’s participation in the use of Pitch-Space.

The Released Parties assume no responsibility, and shall not be liable for, (a) any damage to an entrant’s computer system which is occasioned by accessing the Pitch-Space Website, or for any computer system, phone line, hardware, software, or program malfunctions, or other errors, failures, delayed computer transmissions, or network connections, or for the incorrect or inaccurate capture of information, or the failure to capture any information; (b) incomplete, garbled, misdirected, late, lost, damaged, or stolen entries. (c) interrupted, inaccessible, or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connections; (d) miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone, cable transmissions or other communications; or (e) for any technical malfunctions, failures, difficulties, or other errors of any kind or nature; (e) the accuracy or validity of information supplied by the users of the site including all startups and investors.

 

GOVERNING LAW: ALL ISSUES AND QUESTIONS CONCERNING THE RIGHTS AND OBLIGATIONS OF ENTRANTS AND/OR ADMINISTRATOR IN CONNECTION WITH THE CHALLENGE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NORTH CAROLINA WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAWS RULES OR PROVISIONS.
